Rooftop Decks

1. All permit applications for "Rooftop Decks" must have construction documents signed and sealed by a Professional Engineer or Architect licensed in the State of Maryland.

2. Any rooftop deck that is to be supported by a Party Wall, owners of affected adjoining properties must be notified in writing by Certified Mail Return Receipt and evidence of this notice must be submitted with the construction documents.

3. The Engineer/Architect must make sure that the electrical service attachment to the building is in compliance with the power company's rules and that of the City of Baltimore.

4. No rooftop deck may be raised more than two feet (2') above the plain that is midway between the lowest and the highest points of the roof surface supporting the rooftop deck.

5. A rooftop deck must comply with the following minimum setbacks:

Front

Flat roof...................................8 feet from face of building wall

Gabled roof...............................................6' behind ridge line

Mansard roof (steeply pitched front slope followed by flat roof)..............................6 feet behind ridge line

Sides and Rear............................................................none

And any greater or additional setback requirements established by or under the Baltimore City Zoning Code and applicable Urban Renewal Plan.

6. Electrical Service Conductors must have a clearance of 36" horizontal and at least 8' vertical at the lowest point above the deck surface.

7. For rooftop and all other decks, it is the responsibility of applicants to comply with all necessary electrical clearances according to Code. If such clearances infringe on the rights of adjoining homeowners it is the applicant's responsibility to settle all disagreements where such infringement becomes an issue.
